LoadingPocket OT is designed to be an educational wellness tool for connection and play. By using this application, you agree to the following Terms & Conditions:
1. Not an Occupational Therapy ServicePocket OT is a parenting wellness app. It is not an occupational therapy service, does not provide occupational therapy, and does not employ or represent registered occupational therapists. The name "Pocket OT" refers to the product; it is not a claim of clinical practice. All content is general educational information intended to inspire play and connection, not clinical assessment, diagnosis, or treatment. Always consult a qualified paediatrician, occupational therapist, or other licensed healthcare professional for personalised advice.
2. Assumption of Risk & LiabilityYou assume full responsibility for your child's safety. Every child and environment is different. Always inspect household items, nature finds, and food for choking hazards, sharp edges, or allergies before playing. Pocket OT and its creators are not liable for any injuries, accidents, or damages arising from the use of activities suggested in this app.
3. Active Supervision RequiredAll activities, especially those involving water, climbing, sensory materials, or heavy work, require continuous, direct active adult supervision. Never leave your child unattended during an activity. Stop any activity your child finds distressing.
3a. Personalised Activity SuggestionsActivity recipes, SOS suggestions and other in-app guidance are produced by an evidence-informed play framework with built-in safety parameters and tailored to the profile you set up for your child. They are educational and play-based, not clinical advice. Every child is different — you remain the expert on your child. You agree to use your own parental judgment, supervise actively, and stop any activity that does not feel right. A "Flag this activity" button is provided on every recipe so you can route concerns directly to our clinical reviewer. Pocket OT is not liable for injury or harm resulting from activities performed without appropriate adult supervision.
4. Data Privacy & StoragePocket OT prioritizes your privacy. Profile data, journal entries, and photo uploads are stored locally on your device or in secured databases in accordance with our Privacy Policy. We do not sell your personal data.
5. No WarrantyThe app and its contents are provided "as is" without warranty of any kind. We do not guarantee that the sensory recommendations will result in specific outcomes for your child's behavior or development.
6. Security & POPIA ComplianceWe employ industry-standard encryption for data storage and transmission. In accordance with the Protection of Personal Information Act (POPIA), you retain complete ownership of your data and have the "Right to be Forgotten." You may permanently delete your account and all associated data at any time.
7. Subscriptions & BillingPocket OT offers auto-renewable subscriptions. Payment is charged to your Apple ID account (for iOS) or via Paystack (for web) at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your device Settings > Apple ID > Subscriptions after purchase. Any unused portion of a free trial period will be forfeited when you purchase a subscription. Prices may vary by region and are displayed in your local currency at the time of purchase.
8. EligibilityYou must be at least 18 years old to create a Pocket OT account. By signing up you confirm that you are an adult parent, guardian, or caregiver. Accounts found to be created by minors will be deleted.
9. Governing Law & JurisdictionThese Terms are governed by the laws of the Republic of South Africa, without regard to its conflict-of-laws principles. The courts of South Africa will have non-exclusive jurisdiction over any dispute arising out of or relating to these Terms or your use of Pocket OT.
10. International Users (GDPR / UK GDPR)If you access Pocket OT from the European Union, the United Kingdom, or another jurisdiction with its own data-protection or consumer-protection laws, you also have rights under those laws. We process personal data of EU/UK users in accordance with the GDPR and UK GDPR — see our Privacy Policy for details of the lawful bases, sub-processors, and your data-subject rights (access, rectification, erasure, restriction, portability, objection).
11. Non-Waivable Consumer RightsNothing in these Terms limits, excludes, or modifies any consumer guarantees, rights, or remedies that you have under the South African Consumer Protection Act, the UK Consumer Rights Act 2015, EU consumer law, or any other mandatory law of your country of residence that cannot be lawfully waived. Where a clause in these Terms would do so, that clause does not apply to you to the extent of that conflict.
12. Not for Medical EmergenciesPocket OT is not an emergency service and must never be used to seek help during a medical emergency. If your child is unsafe, choking, unresponsive, having a seizure, or has ingested something harmful, hang up the app immediately and call your country's emergency number (ZA 10177, UK 999, US/Canada 911, EU 112, AU 000, NZ 111).
